Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of MacerFitness — including our website, web application, and related services (together, the “Service”). By creating an account, joining the waitlist, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is

MacerFitness generates personalized training and nutrition guidance — such as workout programs, calorie and macronutrient targets, progress tracking, and AI-assisted estimates (for example, photo-based body fat estimates) — based on information you provide about yourself, your goals, and your available equipment.

3. Not medical advice

The Service provides general fitness and nutrition information for educational purposes only. It is not medical advice, is not a medical device, and is not a substitute for the advice of a physician, registered dietitian, or other qualified health professional. Body composition estimates, calorie targets, and training recommendations are approximations and may be inaccurate for your individual circumstances.

• Consult a qualified health professional before starting any exercise or nutrition program, especially if you have (or suspect you have) any medical condition, are pregnant, or are taking medication.
• Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or other concerning symptoms.
• Never disregard professional medical advice, or delay seeking it, because of something the Service told you.

4. Eligibility and your account

You must be at least 18 years old to use the Service. You agree to provide accurate information when creating your account and completing onboarding, to keep your login credentials confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account. Access may require an invite code during early access; invite codes are non-transferable unless we say otherwise.

5. Subscriptions and billing

Some features require a paid subscription. Payments are processed by Stripe; we do not store your full card details. Unless stated otherwise at checkout, subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time through the billing portal in your account settings, and cancellation takes effect at the end of the current billing period. We may change prices with reasonable advance notice; changes apply from your next renewal. Except where required by law, fees are non-refundable.

6. Generated content

Parts of the Service are produced by automated systems. This output can be incomplete, inaccurate, or unsuitable for your situation, and you should apply your own judgment before relying on it. We do not guarantee any particular fitness, health, or body composition outcome from following generated plans or estimates.

7. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• upload photos of another person without their consent, or any content that is unlawful or infringes someone else's rights;
• attempt to probe, disrupt, overload, or gain unauthorized access to the Service, other users' accounts, or our infrastructure;
• scrape, harvest, or bulk-extract data from the Service, or use automated means to access it except through interfaces we provide;
• reverse engineer, resell, or commercially exploit the Service without our written permission;
• circumvent usage limits, invite restrictions, or billing.

8. Your content

You retain ownership of the information and photos you submit to the Service. You grant us a limited, non-exclusive license to process that content solely to operate, provide, secure, and improve the Service for you — for example, sending your photos to our AI provider to compute a body fat estimate. Details of how we handle your data are in the Privacy Policy.

9. Intellectual property

The Service — including its software, design, branding, and content we create — is owned by MacerFitness or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as intended.

10. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service; where practical we will give you reasonable notice. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) do survive.

11. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. To the maximum extent permitted by law, MacerFitness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your exercise or nutrition choices, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Changes to the Service or these Terms

We are actively developing the Service and may change, add, or remove features at any time. We may also update these Terms; if we make material changes we will notify you (for example by email or an in-app notice) before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms, and any dispute or claim arising out of them or the Service, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer resident elsewhere in the UK or EU, you keep the benefit of any mandatory consumer protections of, and the right to bring proceedings in, your country of residence. MacerFitness is operated from London, United Kingdom; registered company details will be added here once incorporation completes.
